Storista — Acceptable Use Policy

This Acceptable Use Policy (the "AUP") governs the content you create with, and the conduct you engage in through, the Storista platform and services (the "Service") operated by Storista LLC ("Storista," "we," "us"). This AUP is incorporated into and forms part of the Storista Terms of Service at /terms-of-service (the "Terms"). Capitalized terms not defined here have the meaning given in the Terms. Violating this AUP is a material breach of the Terms and may result in removal of content, suspension, or termination.
This AUP applies to you and to any Authorized User you permit to access your account.
1. Avatars are synthetic — no real-person likenesses
1.1 Storista's Avatars are artificially generated synthetic personas. They do not depict, and are not intended to depict, any real, identifiable individual.
1.2 You may not use the Service to create, or attempt to create, content that depicts, imitates, or is reasonably recognizable as any real person — including any celebrity, public figure, or private individual — or that recreates a real person's face, voice, or distinctive likeness, unless you hold all rights and consents required by law and we have authorized it in writing.
1.3 You may not attempt to circumvent, disable, degrade, or defeat any safety, moderation, watermarking, or likeness-detection mechanism in the Service.
2. No deceptive endorsements or testimonials
You acknowledge that Outputs depict synthetic performers, not real consumers. You may not:
2.1 present Output as a genuine, independent, or verified review, testimonial, or endorsement by an actual consumer or real person;
2.2 create or disseminate fake or misleading reviews or testimonials, or misrepresent an Avatar as an unaffiliated or real user of any product or service;
2.3 cause an Avatar to make claims about any product or service that are false, deceptive, or that you cannot substantiate.
You are solely responsible for the truthfulness and substantiation of all claims in your Generated Content and for compliance with the U.S. Federal Trade Commission Act, the FTC rule on the use of consumer reviews and testimonials (16 CFR Part 465), the FTC Guides Concerning the Use of Endorsements and Testimonials, and all comparable laws wherever your content is published.
3. AI transparency and provenance
3.1 Disclosure. You are responsible for disclosing, clearly and wherever legally required, that your Generated Content is artificially generated or manipulated, including as required by Article 50 of the EU AI Act and other applicable transparency laws.
3.2 Provenance integrity. We apply provenance and transparency signals to Output (which may include C2PA Content Credentials, metadata, watermarks, and/or visible or machine-readable labels). You must not remove, alter, obscure, falsify, or otherwise tamper with these signals.
4. Prohibited content
You may not use the Service to create, upload, store, or distribute content that:
- is unlawful, fraudulent, deceptive, defamatory, or trade-libelous;
- infringes or misappropriates any intellectual-property, privacy, publicity, or other right;
- sexualizes minors or constitutes child sexual abuse material (zero tolerance; we report as required by law);
- is sexually explicit, pornographic, or sexually suggestive;
- promotes or facilitates violence, terrorism, self-harm, harassment, hate, or discrimination against protected groups, or provides material support to sanctioned or terrorist entities;
- impersonates any person or entity or falsely suggests affiliation, sponsorship, or endorsement;
- spreads disinformation, election interference, or content depicting political candidates, officials, or campaigns, except as expressly permitted by us in writing and in compliance with law;
- concerns regulated categories (e.g., pharmaceuticals, supplements, medical claims, financial products, gambling, alcohol, tobacco, weapons) without all required disclosures, approvals, and substantiation; or
- violates the terms or policies of any platform on which you publish it (including TikTok, TikTok Shop, Shopify, and Meta).
5. Avatar-specific restrictions
5.1 Use only as embodied in Output. Avatars may be used only as they appear within Output you generate through the Service. You may not extract, isolate, save, or reuse an Avatar independently of that Output.
5.2 No resale or sublicensing. You may not sell, resell, sublicense, rent, lend, distribute, or transfer Avatars, or otherwise make them available to any unauthorized party.
5.3 No tokenization or registration. You may not mint, create, offer, or sell non-fungible tokens (NFTs) using any Avatar, and you may not incorporate any Avatar into a patent, trademark, service-mark, or similar filing or registration.
5.4 Constructive use only; no disparagement. You may not use Avatars to disparage, demean, harass, embarrass, or humiliate any individual, group, or competitor, or in any false or misleading comparative advertising.
5.5 No misattribution. You may not present an Avatar as holding genuine personal views, experiences, or affiliations that misrepresent the nature of the content as set out in Section 2.
6. Prohibited conduct toward the Service
You may not, and may not permit any Authorized User or third party to:
- access the Service through any unapproved interface, or allow unauthorized third parties to access it;
- reverse engineer, decompile, disassemble, scrape, or attempt to derive source code or training data, except to the extent this restriction is prohibited by law;
- modify, adapt, or create derivative works of the Service or its documentation;
- interfere with, overload, probe, or disrupt the Service or its infrastructure or security mechanisms;
- use the Service to build or train a competing product, model, or service; or
- use the Service in any manner exceeding the scope licensed in the Terms.
7. Your responsibility as advertiser and publisher
You act as the advertiser and publisher of your Generated Content. You are solely responsible for how, where, and to whom you publish it, including all required disclosures, claim substantiation, sectoral rules, and third-party platform policies. You will not rely on Storista to ensure your content is lawful or compliant in any market.
8. Authorized Users
If you are a Business User, you are responsible for the acts and omissions of your Authorized Users as if they were your own, for ensuring they comply with this AUP and the Terms, and for any breach by them.
9. Enforcement and moderation
9.1 We operate automated and human content-moderation processes, including classifiers and policy review, to enforce this AUP. We may — but are not obligated to — review, screen, block, remove, refuse, or limit Generated Content and features, with or without notice.
9.2 We may ask you to address a violation directly, but we reserve the right to act ourselves — including suspending or terminating access — where we reasonably believe it necessary to comply with law or protect the Service, our users, or third parties.
9.3 We may preserve and disclose content and account information where we reasonably believe it necessary to comply with law, enforce the Terms or this AUP, or protect the rights, safety, or property of any person.
9.4 Notice of action (statement of reasons). Where we remove, block, disable, restrict, or refuse Generated Content, or suspend or terminate your access, on the basis of this AUP, the Terms, or applicable law, we will provide you with a statement of the reasons for that action, to the extent we are legally permitted to do so and unless doing so would compromise an investigation, the safety of any person, the integrity of the Service, or a legal obligation. The statement will, where applicable, indicate the action taken, the ground for it (including whether the content was treated as illegal or as incompatible with our terms), and how you may contest it.
9.5 Appeal. You may contest a moderation decision by submitting our appeal form within 30 days of the notice. We will review the decision, consider any information you provide, and inform you of the outcome. Where we determine that content was removed or restricted in error, we will reinstate it where reasonably possible. This internal appeal does not limit any rights you may have under applicable law, including any right to out-of-court dispute resolution or to a remedy before a competent authority or court.

11. Changes to this AUP
We may update this AUP from time to time. Material changes take effect on the stated effective date or as otherwise communicated. Your continued use of the Service after changes take effect constitutes acceptance.
